This copyright agreement is a contract between BJ & SP Ryan Pty Ltd and the
client of the aforementioned business. When a client commissions
BJ & SP Ryan Pty Ltd to create a web site, the following contract
terms are applicable.
BJ & SP Ryan Pty Ltd (hereon referred to as "RyServ") has been
commissioned by the client to create a commercial web site. All
web sites designed by Ryserv are protected in Australia by the Copyright
Act, 1968.
1. RyServ, as the original author of the web site, owns the copyright to web site
as a whole. This includes the design, layout, HTML coding, ASP coding
and any images created by RyServ. If the client wants to include
images in the web site (which are copyright to the client) then
the client is welcome to do so. If this is the case, then a separate
copyright statement will be displayed protecting the client's copyright
for the images being used in the web site. RyServ will not claim
to have any copyright to images that were not produced by RyServ.
Similarly, RyServ do not claim copyright for any text supplied by
the client. In the case where the client asks for a custom-made
design that is the original idea of the client then the statement
"Design by client's name" will appear at the bottom of
the appropriate pages of the site. In all other cases the statement
will read "Created / Designed / Hosted by RyServ. Copyright
RyServ, (Year created)." RyServ reserves the right to add links
to sites created by RyServ on the RyServ client web page of the
RyServ web site.
2. RyServ does not take any responsibility for any content that the client wishes
to display on his/her web site. It is the client's responsibility
to make sure that no copyright is being breached for any images/text
supplied by the client. This means the client must check the source
and copyright of any material that he/she wishes to use and then
obtain permission from the source to use that material before asking
RyServ to put it on the client web site. RyServ is not liable for
such breaches of copyright.
3. RyServ is not responsible for maintaining the functioning of any part of a
client's interactive pages such as ASP forms, checkout baskets,
database connectivity etc. once it has been created and approved
by the client. It is the responsibility of the client to ensure
that interactive parts of the client's web site are working properly.
This is to be done by the client by regular testing.
4. Reproduction (in any format) of any web site created by RyServ is prohibited.
This includes downloading pages from the Internet.
5. A client may be given FTP access to the web site files for the specific purpose
of self maintenance. If this is the case then the client must only
make minor changes to the text and/or images owned by the client.
Changes to the design or layout are not permitted without the permission
of RyServ.
6. For security reasons, the client must not give the FTP password access information
to anyone. The client must make sure that the FTP information is
kept private and in a safe and secure place.
7. RyServ are able to provide a maintenance service to the client whereby minor
changes will be carried out for a fee.
8. If the client asks another company to do maintenance on the client's site, then
the client must first ask for permission from RyServ. If permission
is granted then the client must inform the other company that the
original site is protected by copyright to RyServ. RyServ will acknowledge
the other company's work with a small hyperlink embedded in a sentence
at the bottom of the homepage only. No copyright statement will
be shown for the other company because minor changes to the client's
site constitutes maintenance and not original work.
